Information Clause for Candidates

Pursuant to Article 13 (1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 94/46/EC (hereinafter referred to as the GDPR), in connection with the acquisition of your data, we hereby inform you as follows:

  1. Your personal data will be processed by us for the following purposes:
    • Conducting the recruitment process for which you are applying;
    • Conducting future recruitment processes, provided you have given your consent.
  2. The legal basis for processing your data is:
    • Applicable provisions of law namely Article 22¹ of the Polish Labour Code, which authorises us to process your data for the purpose of concluding an employment contract within the scope of such data as: your name(s) and surname, parents’ names, date of birth, place of residence (correspondence address), education and employment history (legal basis: Article 6(1)(c) of the GDPR);
    • Your consent – if, in your CV, job application or cover letter, you provide us with data other than those listed in point 1 above (e.g. your image, e-mail address or mobile phone number), or if the process concerns another form of employment, or if you decide to undergo a data verification process, including, among others, verification of your professional background, the legal basis for our processing of such data will be your consent (legal basis: Article 6(1)(a) of the GDPR);
    • The legitimate interest of the Controller – in the course of the recruitment process, we may be interested in conducting a job interview with you. We have a legitimate interest in using the data obtained during such an interview to assess your skills and abilities and to evaluate whether you are a suitable person for the position for which we are recruiting, as well as in carrying out statistical activities analysing candidates’ interest in the position indicated in the job advertisement (legal basis: Article 6(1)(f) of the GDPR).
  3. Your personal data will be processed by us for a period of 12 months from the date of completion of the recruitment process for the position to which you are applying. If, however, you give your consent (which you may do, for example, by means of the CV submitted to us) for your data to also be processed for the purposes of potential future recruitment processes, your data will be processed by us for a period of 10 years or until your consent is withdrawn. 
  4. The recipients of your personal data will be the Controllers’ employees and associates, within the scope of their official duties and on the basis of an authorisation, as well as cooperating entities that support the Controllers in achieving the purpose – such entities process your data on the basis of an agreement concluded with us and only in accordance with our instructions, pursuant to the requirements of Article 28 of the GDPR. Personal data may also be disclosed to entities authorised to receive such data under provisions of law. In the event of consent to participate in future recruitment processes, the Controllers will consider your candidacy in other recruitment processes which they conduct – both future and ongoing in parallel. Where the recruitment is conducted on behalf of another entity, your CV may be made available to a third party, but only with your consent.
  5. We would like to inform you that in connection with the processing of your data by us, you have the right to access the content of your personal data, as well as the right to rectification, erasure, restriction of processing, the right to data portability, and the right to object to the processing of your data. To the extent that we process your data based on your consent – you have the right to withdraw your consent to data processing at any time; however, this remains without effect on the lawfulness of the data processing carried out based on the consent prior to its withdrawal. You can withdraw your consent by sending a statement of withdrawal of consent to our correspondence address or to our e-mail address provided in point 7.

  7. Each Controller has appointed a Data Protection Officer. Respondents may contact the Data Protection Officer for Pramtent Sp. z o.o. at: iod.pramtent@ready4s.com
  8. Should you consider that the processing of your personal data infringes the provisions of the GDPR, you have the right to lodge a complaint with the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych).
  9. The provision of personal data by you within the scope arising from the provisions of the Polish Labour Code is mandatory, while in the remaining scope it is voluntary and results from the consent given by you to the processing of the data. The consequence of your failure to provide the data will be the inability to participate in the recruitment process for the position to which you are applying.
  10. Your personal data will not be transferred to third countries or international organizations.
  11. Your data will not be processed in an automated manner, including in the form of profiling, which means that no decisions producing legal effects in relation to you or similarly significantly affecting you will be based solely on the automated processing of personal data, nor will they entail any such automatically made decisions.
